Man Found Lying in Grass After Accident, Charged With DWI

Police said a Kinnelon man was allegedly riding a motorcycle without a helmet.

A 45-year-old Kinnelon man was charged with DWI Sunday after said they found him laying face down in the grass near Kakeout Road complaining of head pain, his motorcycle allegedly off the road in a ditch.

Jeffrey D. Fogarty was charged with DWI, driving with a suspended license, failure to keep right, failure to wear an approved helmet, not having a motorcycle endorsement on his driver’s license, failure to exhibit registration and failure to exhibit proof of insurance.

Police responded to the motor vehicle accident after receiving a call at 11:55 p.m. that a motorcycle had driven off the road and was in a ditch. Police saw the black 2009 Harley Davidson when they arrived and determined that the motorcycle had allegedly hit a speed sign before coming to rest.

A white male later determined to be Fogarty was found near the motorcycle laying in the grass, allegedly not wearing a helmet and complaining of pain. Police said he allegedly smelled of alcohol and had slurred speech.

Fogarty was transported to Chilton Memorial Hospital by He was later released with a ticket to appear in court at a later date.
