Wayne Man Arrested With Open Beer in Car

Police said man allegedly admitted to being hungover from previous night.

A 31-year-old Wayne man was arrested on DWI charges Saturday after police said he allegedly had an open thirty-pack of beer on the floorboard of his front passenger seat and an open can of beer in the cup holder of the center console.

In addition to DWI, Sean P. Hughes was charged with refusal to submit to a breath test, having an open container of alcohol in a motor vehicle, having an overdue inspection sticker, careless driving, having unclear plates and not having liability insurance.

According to , Sgt. Christopher Burns was patrolling Route 23 at 11:15 a.m. when a vehicle pulled alongside him honking his horn. Police said the driver who was honking was an off-duty West Milford police officer who reported that a 1999 Dodge pickup traveling in front of him was weaving in and out of lanes.

Police said Sgt. Burns followed the truck and witnessed the driver travel in and out of its lane. Sgt. Burns stopped the vehicle and was met with Hughes.

In addition to allegedly noticing the beer, police said Sgt. Burns smelled alcohol on Hughes and noticed him having slurred speech. Police also said Hughes failed several field sobriety tests. Police also said Hughes allegedly admitted to being hungover from a wedding the previous night.

He was arrested and transported to the Kinnelon police station. He was later released with a ticket to appear in court at a later date.
